Welcome to Job8.net ("Web site"), owned and produced by Forest China Limited and Job8.net Limited ("Company"). The Web site provides its service to you, subject to the following Terms and Conditions, which may be updated by the Company from time to time without notice to you. Please read this page carefully. If you do not accept the Terms and Conditions stated here, do not use the Web site and service. By using the Web site, you are indicating your acceptance to be bound by the Terms of this Agreement. You should visit this page periodically to review the Terms and Conditions, because they are binding on you. The terms "You" and "User" as used herein refer to all individuals and/or entities accessing the Web site for any reason.


Acceptable Site Use
General Rules
You may not use the Web site in order to transmit, distribute, store or destroy material (i) in violation of any applicable law or regulation, (ii) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (iii) in a manner that is defamatory, obscene, threatening, abusive or hateful.

Specific Uses - Job Seeker(s)
(i) Job Seekers are hereby granted a limited, terminable, non-exclusive right to access and use the Web site solely for their personal use seeking employment opportunities for themselves. This authorizes the Job Seekers to view and download a single copy of the material on the Web site only for their personal, noncommercial use. Their use of the Web site are privilege. The Company reserves the right to suspend or terminate that privilege for any reason at any time, in its sole discretion.

(ii) Job Seekers are entitled to send their resumes directly to any employer who advertises on or through the Company Web site. The Job Seekers will be solely responsible for all the contents and materials contained in their resumes. Without incurring any liability thereon, the Company reserves the right to examine and reject the content and materials of the resumes submitted by the Job Seekers.

(iii) Job Seekers may send their resumes to the Company through the Web site, and the resumes will be stored in the Company's database and they will not be deleted unless and until the Job Seekers notify the Company to do so.

(iv) Job Seekers shall not send false, illegal or inaccurate personal particular or information in the resumes.

(v) Job Seekers' resumes will not be released to any recruiters without the Job Seekers' permission but the Company may release the Job Seekers' brief resumes (without particular personal data) to third parties through the Web site.

(vi) The Company will not be responsible or held liable, in any way, should the Job Seekers personal data be used by recruiters for any other use other than for obtaining potential employees or workers.

Specific Uses - Employers
(i) Upon payment of the service fee to the Company and/or upon other terms and conditions, Employers are hereby granted a limited, terminable, non-exclusive right to access and use the Web site to advertise job vacancies and/or create their own web page on the Company's Web site for a predetermined period following agreement of the predetermined service.

(ii) Employers will be solely responsible for all the contents and materials contained in their advertisement. Without incurring any liability thereon, the Company reserves the right to examine and reject the content and materials of the advertisement submitted by the Employers.

(iii) Employers will also be entitled to access the Job Seekers' Database but agree that all information only be used for their internal businesses use seeking potential candidates for employment.

(iv) The Company reserves the right to suspend or terminate the Employers' access and use at any time if the Company determines that the Employers are in breach of any of these Terms and Conditions.

Prohibited Uses - Job Seeker(s) and Employer(s)
The Web site may be used only for lawful purposes by individuals seeking employment and employers, recruitment agencies seeking employees or candidates. The Company specifically prohibits any use of the Web site, and requires all users to agree not to use it, for any of the following:

(i) Do Not post to the Web site any illegal, incomplete, false or inaccurate resume information or information which is not your own accurate resume.

(ii) Do Not delete or revise any material posted by any other person or entity.

(iii) Do Not print out or otherwise copy or use any personally identifiable information about employees or business information about employers.

(iv) Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited.


Intellectual Property Rights
All materials (Information, Graphics, Texts, Image, Content and Designs) contained on the Web site are the intellectual properties of the Company and, unless otherwise indicated, are protected by law including, but not limited to, England copyright, trademark law, as well as international laws and regulations. In accessing the Web site, users agree that the content may only be downloaded for own personal non-commercial use.


Assumption of Risk
You use the Web site solely at your own risk and subject to all applicable local and international laws and regulations. While the Company has endeavored to create a secure and reliable site, please be advised that the confidentiality of any communication or material transmitted to/from the Web site over the Internet cannot be guaranteed. Accordingly, the Company and its affiliates are not responsible for the security of any information transmitted via the Internet, the accuracy of the information contained on the Web site, or for the consequences of any reliance on such information. You assume the sole and complete risk for using the Web Site.


Disclaimer of Warranties

(i) The Company disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material in the Web site.

(ii) The Company disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any information or material.

(iii) The Company disclaims any responsibility for any harm resulting from downloading or accessing any information or material through the Web site.

(iv) Information or material in the Web site are Provided "As Is," with No Warranties Whatsoever.

Limitation of liability
Under no circumstances shall the Company be liable to any user on account of that user's use or misuse of and reliance on the Web site. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages (even if the Company has been advised of the possibility of such damages). Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the Web site, from inability to use the Web site, or from the interruption, suspension, or termination of the Web site (including such damages incurred by third parties). Indemnification
You agree to indemnify the Company, its directors, officers, shareholders, parents, subsidiaries, affiliates, agents and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your violation of these Terms of Use.


Termination
You agree that the Company, in its sole discretion, may terminate your registration or use of the Web site; delete your postings from the Web site, for any reason, including, without limitation, for lack of use or if the Company believes that you have breached any of these Terms and Conditions or laws or if the Company is unable to verify or authenticate any information you submit to the Web Site.


Governing Law and Jurisdiction
The Company's Terms and Conditions and any dispute or matter arising from or incidental to your use of the Web site shall be governed by and construed in accordance with the laws of the England and both you and the Company agree to submit to the jurisdiction of the courts of the England.
